District Dairy Cooperative WART-MILK,
hereinafter referred to as the "Cooperative", informs that is or may
be in the possession of your personal data and that performs or will process
them as an administrator within the meaning and on the basis of the GDPR, i.e.
the Regulation of the European Parliament and Of the Council (EU) 2016/679 of
27/04/2016 on the protection of individuals with regard to the processing of
personal data and on the free movement of such data, and repealing Directive
95/46 / EC (Journal of Laws UE L 119, p. 1) ).

If you are:
1) a member of a Cooperative - the
processing of personal data is an obligation under the provisions of the Act of
September 16, 1982, Cooperative Law, Journal Of Laws of 2017, item 1560 [as
provided for in Art. 6 sec. 1 letter c) GDPR];
2) a candidate for a member of the
Cooperative - the processing of personal data takes place on the basis of your
consent and intention to become a member *, which is possible under Art. 6 sec.
1 letter a) and b) GDPR];
3) an employee of the Cooperative or a
person providing services to the Cooperative on the basis of a civil law
contract - the processing of personal data takes place on the basis of your
consent and for the purpose of performing and on the basis of a contract
between you and the Cooperative, and is also an obligation under the provisions
Of the Labor Code or the Civil Code, as well as other provisions regulating the
rights of obligations of the employer and employee, as well as the service
provider and service recipient, including provisions in the field of
occupational medicine, social security, property and health insurance, or on
trade unions [which results from Art. 6 sec. 1 letter b) and c) GDPR];
4) a person applying for employment in the
Cooperative's workplace or offering its services to the Cooperative in order to
conclude a civil law contract - the processing of personal data takes place on
the basis of your consent and in order to conclude an employment contract or a
civil law contract with the Cooperative, and is also an obligation on the basis
of the provisions of the Labor Code or the Civil Code [which results from Art.
6 sec. 1 letter b) and c) GDPR];
5) a family member of an employee of the
Cooperative - the processing of personal data takes place in order to perform
and on the basis of an employment contract between your family member who is
that employee and the Cooperative, and is also an obligation under the
provisions of the Labor Code and other provisions regulating the rights,
obligations of the employer and employee [which results from art. 6 sec. 1 letter
b) and c) GDPR];
6) a family member of a cooperative member
- the processing of personal data takes place on the basis of your consent and
is an obligation under the provisions of the Act of September 16, 1982,
Cooperative Law, Journal Of Laws of 2017, item 1560 * which results from art. 6
sec. 1 letter a) and c) GDPR];
7) a supplier of goods or services for the
Cooperative, an entity offering the Cooperative the supply of goods or
services, or an employee of such a supplier - the processing of personal data
takes place on the basis and for the purpose of performing a contract between
you or your employer and the Cooperative or to conclude such a contract and in
order to fulfill a legal obligation under the provisions of tax laws * which *
which results from art. 6 sec. 1 letter b) and c) GDPR];
8) the buyer of goods or services sold by
the Cooperative, the entity to which the Cooperative offers the supply of goods
or services, or an employee of one of these entities - the processing of
personal data takes place in order to properly perform or conclude a contract
with the Cooperative and in order to fulfill a legal obligation under the
provisions of tax laws * which results from art. 6 sec. 1 letter b) and c) GDPR].
In addition, the Cooperative may process
your personal data if:
9) will have a basis to assume that it is
necessary to protect your vital interests *, as authorized by art. 6 sec. 1 letter
d) GDPR], which it is not able to specify at the stage of creating this
information;
10) it turns out to be necessary for the
consideration of your comments regarding its activities or the offer of
products or services, or for considering the complaint * which is based on art.
6 sec. 1 letter f) GDPR];
11) it will be required by the legitimate
interest of the Cooperative *, which is also provided for in Art. 6 sec. 1 letter
f) GDPR]:
a) when it is necessary to prove a fact;
b) when it is necessary to establish,
investigate or defend against a claim;
c) when it decides to interest you in
products or services under direct marketing.
The Cooperative informs that if your
personal data has not been obtained directly from you, the scope of the data it
processes includes no more than names and surnames, addresses of residence, tax
identification numbers as well as e-mail addresses and telephone numbers.
If you want to enter the premises of the Cooperative's
enterprise with a motor vehicle, you should take into account that the
Cooperative will record and remain in the possession of the vehicle
registration number.
If you are on the premises of the
Cooperative's enterprise, you will be subject to video surveillance recording
the image of the person.
Your personal data may be made available by
the Cooperative to public administration authorities, legal and judicial
authorities, companies and institutions in the field of social, health and
property insurance and health protection, as well as entities whose cooperation
it uses, such as lawyers, tax advisers, statutory auditors or IT specialists.
The name and surname, job position, as well
as the official e-mail address and telephone number of the Cooperative's
employee may be made available in the content of the documents that the
Cooperative generates in connection with the purchase of goods, materials and
services necessary for its operation, as well as in the content of documents
that it issues goods and services in connection with the sale of goods and
services and, in accordance with applicable law, issues to recipients,
including intermediaries, goods and services, including as part of
intra-Community delivery of goods and exports to countries outside the European
Union.
Your personal data as:
i. a member of the Cooperative or a member
of his family and in the case of a former member of the Cooperative - will be
kept by the Cooperative for the duration of its existence;
ii. a candidate for a member of the
Cooperative who has not obtained membership - will be kept by the Cooperative
for a period of 1 year;
iii. an employee of the Cooperative - will
be kept by the Cooperative for the period of his employment, and after the
termination of his employment - for the period prescribed by law;
iv. a family member of an employee of the
Cooperative - will be kept by the Cooperative for the period in which these
data will be necessary to determine the employee's rights to specific
benefits;
v. persons providing services to the
Cooperative on the basis of a civil law contract - will be kept by the
Cooperative for a period of up to 6 years
from the end of cooperation;
vi. a person applying for employment in the
Cooperative's workplace, with whom the employment relationship has not been
established - will be kept by the Cooperative for the period of 3 months, and
if you consent to the use of this data in the process of future recruitment -
for a period of 3 years;
vii. suppliers of goods, materials or
services for the Cooperative or an employee of such supplier - will be stored
by the Cooperative for a period of 6 years from the end of cooperation;
viii. a supplier offering the Cooperative
the supply of goods, materials or services or an employee of the entity
offering the Cooperative the supply of goods or services - will be stored by
the Cooperative for a period up to 1 year from receiving the offer;
ix. the buyer of goods or services sold by
the Cooperative, the entity to which the Cooperative offered the delivery of
goods or services, or an employee of one of these entities - will be kept by
the Cooperative for a period of 6 years from the end of cooperation;
x. another person whose personal data will
remain in the possession of the Cooperative as having a legitimate interest -
will be kept by the Cooperative for the period of limitation of any claims;
xi. the potential addressee of the
Cooperative's activities as part of direct marketing of its products and
services - they will be stored by the Cooperative until you object to the
processing of his / her data for this purpose or withdraw your consent, if the
processing of these data was based on marketing consent, or the Cooperative
itself will recognize the inadequacy of this data for marketing.
In connection with the processing of his /
her personal data, you have the right to:
a) access to this data, receiving a copy
thereof;
b) rectify (correct) your data;
c) requested to remove them;
d) requests to limit the processing of
data, e.g. only to their storage or to perform only specific activities;
e) object to data processing;
f) request the release of your data
provided under the contract or your consent in a structured, commonly used
machine-readable format and the right to request that this data be sent to
another entity;
g) lodging a complaint to the President of
the Personal Data Protection Office;
h) withdraw consent to the processing of
your personal data.
If the Cooperative wants to obtain his/her
personal data from you, the provision of this data may be:
- statutory requirement - in the case of
which the Cooperative will indicate a legal provision that provides for such a
requirement;
- a condition for concluding a contract;
- a requirement resulting from the
contract;
- voluntary.
Failure to provide personal data in such a
case may result in the fact that a contract with you will not be concluded, the
contract will be terminated, you will not become a member of the Cooperative or
the Cooperative will be able to refuse its benefit or claim compensation.
The Cooperative may obtain personal data from the
website of your company, his/her public profile or from a public register.
